GENERAL TERMS

By accessing and placing an order with Kofi Schulz and its affiliated service, Kofi Football, you confirm that you are in agreement with and bound by the Terms & Conditions outlined below. These terms apply to the entire website and any email or communication between you and Kofi Schulz or Kofi Football. Under no circumstances will Kofi Schulz or Kofi Football be liable for any direct, indirect, special, incidental, or consequential damages, including loss of data or profit, arising from using the information in this document. Even if Kofi Schulz or Kofi Football or an authorized representative has advised of the possibility of such damages, if you use the materials on these sites and need servicing, repair or correction of equipment or data, you assume those costs. Kofi Schulz and Kofi Football will not be responsible for any outcome that may occur while using our resources. We reserve the right to change prices and revise the resource usage policy at any moment.

LICENSE

Kofi Schulz, including its affiliated service Kofi Football, grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the website, strictly by the terms of this agreement. These Terms & Conditions are a contract between you and Kofi Schulz (referred to in these Terms & Conditions as 'Kofi Schulz,' 'us,' 'we,' or 'our'), the provider of the Kofi Schulz website and the services accessible from the Kofi Schulz website, including Kofi Football. You agree to be bound by these Terms & Conditions. Please do not use the Kofi Schulz Service, including Kofi Football, if you disagree with these Terms & Conditions. In these Terms & Conditions, 'you' refers to both you as an individual and the entity you represent. Suppose you violate any of these Terms & Conditions. In that case, we reserve the right to cancel your account or block access to your account without notice.

Country: The location where Kofi Schulz or the owners/founders of Kofi Schulz, including Kofi Football, are based, which, in this case, is Austria.

 

Device: Any internet-connected device such as a phone, tablet, computer, or other devices can visit the Kofi Schulz and Kofi Football websites and use the services.

 

Service: Refers to the services provided by Kofi Schulz, including its football training academy, "Kofi Football," as described in the relevant terms (if available) and on these platforms.

 

Third-party service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you on both Kofi Schulz and Kofi Football.

 

Website: Kofi Schulz and Kofi Football websites, which are accessible via these URLs: https://www.kofischulz.com, https://www.kofifootball.com and https://www.hoop.bio/kofifootball.

 

You: Refers to an individual or entity registered with the Kofi Schulz and Kofi Football websites to use the services.

RESTRICTIONS

  • Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Kofi Schulz, Kofi Football, or its affiliates, partners, suppliers, or the licensors of the website.

PAYMENT

Suppose you register for any of our recurring payment plans. In that case, you agree to pay all fees or charges to your account for the service by the fees, charges, and billing terms in effect at the time each fee or charge is due and payable. Unless otherwise indicated in an order form, you must provide Kofi Schulz, including Kofi Football, with a valid credit card (Visa, MasterCard, or any other issuer accepted by us) (“Payment Provider”) as a condition to sign up for the Premium plan. Your Payment Provider agreement governs your use of the designated credit card account, and you must refer to that agreement, and not these Terms, to determine your rights and liabilities concerning your Payment Provider. By providing Kofi Schulz, including Kofi Football, with your credit card number and associated payment information, you agree that Kofi Schulz is authorised to verify the data immediately, subsequently invoice your account for all fees due and payable to Kofi Schulz, including Kofi Football, hereunder, with no additional notice or consent required. You agree to immediately notify Kofi Schulz of any change in your billing address or the credit card used for payment. Kofi Schulz, including Kofi Football, reserves the right to change its prices and billing methods immediately upon posting on our site or by e-mail to your organisation’s administrator(s). Any attorney fees, court costs, or other costs incurred in the collection of undisputed delinquent amounts shall be the responsibility of and paid for by you. No contract will exist between you and Kofi Schulz, including Kofi Football, for the service until Kofi Schulz, including Kofi Football, accepts your order by a confirmatory e-mail, SMS/MMS message, or other appropriate means of communication. You are responsible for any third-party fees you may incur when using the service.

YOUR HEALTH

Using the Kofi Schulz Service, including Kofi Football, is at your own risk. You must be in good health as a condition to use our service. We strongly advise you to seek medical advice from a doctor before starting the Kofi Schulz Service, including participation in the training academy, especially if you are aware of or have one or more of the following medical conditions complaints or have undergone surgical procedures:

 

  • Cardiovascular disease

  • Lung or respiratory disease (including asthma)

  • Spinal or joint problems

  • Neuromuscular disease

  • Other health-related problems

 

Please be aware that it is your responsibility to verify that the foods and nutrients recommended as part of the coaching or guidance do not contain any ingredients or contents to which you are allergic or which may cause food intolerance. Additionally, we want to remind female athletes that pregnant women and breastfeeding mothers should not participate in our academy training or follow nutritional advice from us.

 

In general, listening to what your body tells you is crucial. If you have any doubts about your health or medical condition, please consult your doctor before starting or continuing with the Kofi Schulz Service. The information and services provided by the Kofi Schulz Service, including Kofi Football, are not medical advice and should not be considered a substitute for a medical examination or treatment by a qualified medical professional.

 

Football, fitness, or nutritional advice is subject to continuously evolving knowledge. While we base our training and nutrition recommendations on recent studies and expertise, we cannot guarantee that they always reflect the most up-to-date research conclusions or expert opinions.

RETURN AND REFUND POLICY

You acknowledge and agree that Kofi Schulz and Kofi Football shall not be responsible for any third-party services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. Kofi Schulz and Kofi Football do not assume and shall not have any liability or responsibility to you or any other person or entity for any third-party services. Third-party services and links to them are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third-party service Terms & Conditions.

TERMINATION

This agreement shall remain in effect until terminated by you or Kofi Schulz. In its sole discretion, Kofi Schulz, including Kofi Football, may suspend or terminate this agreement with or without prior notice at any time and for any or no reason. This agreement will terminate immediately, without prior notice from Kofi Schulz, if you fail to comply with any provision of this agreement. You may also terminate this agreement by deleting the website and all copies from your computer. By ending this agreement, you shall cease all website use and delete all documents from your computer. Termination of this agreement won't limit any of Kofi Schulz's or Kofi Football's rights or remedies in law or equity in case of breach by you during the term of this agreement.

If you are a copyright owner or such owner’s agent and believe any material on our website, including Kofi Football, constitutes an infringement of your copyright, please get in touch with us by providing the following information:

INDEMNIFICATION

You agree to indemnify and hold Kofi Schulz and its parents, subsidiaries, affiliates, officers, employees, agents, partners, and licensors, including Kofi Football (if applicable), harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your:

 

  1. Use of the website, including Kofi Football.

  2. Violation of this agreement or any law or regulation.

  3. Violation of any right of a third party.

 

This indemnification provision applies to both Kofi Schulz and Kofi Football.

NO WARRANTIES

The website, including Kofi Football, is provided “as is” and “as available,” with faults and defects, without a warranty. To the maximum extent permitted under applicable law, Kofi Schulz, on its behalf, affiliates, respective licensors, and service providers, including Kofi Football, expressly disclaim all warranties, whether express, implied, statutory, or otherwise, for the website and Kofi Football, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no representations that the website and Kofi Football will meet your requirements, achieve any intended results, be compatible or work with any other software, websites, systems, or services. Without limiting the preceding, neither Kofi Schulz nor its provider makes any representation or warranty of any kind, express or implied:

 

  1. Regarding the operation or availability of this website and Kofi Football, or any content, information, and materials.

  2. That the website and Kofi Football will function error-free and uninterrupted.

  3. As to the accuracy, reliability, or currency of any information or content provided through the website and Kofi Football.

  4. That the website and Kofi Football, its servers, the content, or e-mails sent from or on behalf of Kofi Schulz are free of viruses, scripts, Trojan horses, worms, malware, timebombs, or other harmful components.

 

Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the constraints of the applicable statutory rights of a consumer. So, some or all of the above exclusions and limitations may not apply to you.

LIMITATION OF LIABILITY

Notwithstanding any damages you might incur, Kofi Schulz and its suppliers, including Kofi Football, are liable for the amount paid by you for the website and Kofi Football.

 

To the maximum extent permitted by applicable law, in no event shall Kofi Schulz or its suppliers, including Kofi Football, be liable for any special, incidental, indirect, or consequential damages, including, but not limited to, damages for loss of profits, data, business interruption, personal injury, or loss of privacy arising out of or in any way related to the use of or inability to use the website and Kofi Football, third-party software or hardware used with the website and Kofi Football, or in connection with any provision of this agreement. This includes situations where you have been notified of the possibility of such damages, and the remedy fails to fix the problem permanently. Kofi Schulz or its suppliers, including Kofi Football, are not liable for any damages.

 

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

SEVERABILITY

The other provisions shall remain unaffected if any provision of this agreement is unenforceable or invalid. In such a case, such provision will be modified and interpreted to achieve the objectives of that provision to the fullest extent possible under applicable law. The remaining provisions, including those related to Kofi Football, will continue in full force and effect.

 

The Terms & Conditions, Privacy Policy, and any other legal notices published by Kofi Schulz, including those related to Kofi Football, constitute the entire agreement between you and Kofi Schulz regarding the services. Suppose any provision of this agreement is deemed invalid by a court of competent jurisdiction. In that case, the invalidity of such provision shall not affect the validity of the remaining provisions of this agreement, including those related to Kofi Football, which shall remain in full force and effect.

 

No term of this agreement shall be considered waived unless it is done so in writing by Kofi Schulz. Kofi Schulz's failure to assert any right or provision under this agreement, including those related to Kofi Football, shall not constitute a waiver of such right or provision. You and Kofi Schulz agree that any cause of action arising from or related to the services, including those associated with Kofi Football, must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

WAIVER

Except as provided herein, the failure to exercise a right or require the performance of an obligation under this agreement, including those related to Kofi Football, shall not affect a party’s ability to exercise such right at any time. Nor shall the waiver of a breach constitute a waiver of any subsequent breach. No failure to exercise or delay in exercising any right or power under this agreement, including those related to Kofi Football, will be a waiver of that right or power. Nor shall any single or partial exercise of any right or power preclude further exercise of that or any other right granted herein, including those related to Kofi Football. In case of a conflict between this agreement and any applicable purchase or other terms, the terms of this agreement, including those associated with Kofi Football, shall govern.

AMENDMENTS TO THIS AGREEMENT

At its sole discretion, Kofi Schulz and Kofi Football reserve the right to modify or replace this agreement at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. We will determine what constitutes a material change at our sole discretion. By continuing to access or use our website services, including those provided by Kofi Football, after any revisions become effective, you agree to be bound by the revised terms. If you disagree with the new terms, you are no longer authorised to use Kofi Schulz and Kofi Football.

ENTIRE AGREEMENT

This agreement, including its terms and conditions, constitutes the entire agreement between you, Kofi Schulz and Kofi Football regarding your website use and services. It supersedes all prior and contemporaneous written or oral agreements between you and Kofi Schulz. You may be subject to additional terms and conditions when you use or purchase other Kofi Schulz and Kofi Football services, which Kofi Schulz and Kofi Football will provide to you at the time of such use or purchase.

UPDATES TO OUR TERMS

We may change our service and policies and need to modify these terms to reflect our service and guidelines, including those related to Kofi Football. Unless otherwise required by law, we will notify you (for example, through our service) before we make changes to these Terms and allow you to review them before they go into effect. Then, if you continue to use the service, including Kofi Football, you will be bound by the updated Terms. You can delete your account if you do not want to agree to these or any updated Terms.

INTELLECTUAL PROPERTY

The website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) belongs to Kofi Schulz, its licensors or other providers of such material. Austria and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws protect them. Do not copy, modify, reproduce, download or distribute the material in any way, in whole or in part, without the express prior written permission of Kofi Schulz, unless and except as is expressly provided in these Terms & Conditions. Any unauthorised use of the material is prohibited.

​AGREEMENT TO ARBITRATE

This section applies to any dispute, except it doesn’t include a dispute relating to claims for injunctive or equitable relief regarding the enforcement or validity of your or Kofi Schulz’s intellectual property rights. The term “dispute” means any dispute, action, or another controversy between you and Kofi Schulz concerning the services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. “Dispute” will be given the broadest possible meaning allowable under the law.

NOTICE OF DISPUTE

In the event of a dispute, you or Kofi Schulz must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party granting it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via e-mail to: info@kofischulz.com. Kofi Schulz will send any Notice of Dispute to you by mail to your address if we have it or otherwise to your e-mail address. You and Kofi Schulz will attempt to resolve any dispute through informal negotiation within sixty days from the date of the Notice of Dispute. After sixty days, you or Kofi Schulz may commence arbitration.

BINDING ARBITRATION

Suppose you and Kofi Schulz don’t resolve any dispute by informal negotiation. In that case, any other effort to resolve the dispute will be conducted exclusively by binding arbitration, as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction as necessary to protect the party’s rights or property pending the completion of arbitration. The non-prevailing party shall bear any legal, accounting, and other costs, fees, and expenses incurred by the prevailing party.

SUBMISSIONS AND PRIVACY

Suppose you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals. Including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and will become the sole property of Kofi Schulz. Without any compensation or credit to you whatsoever. Kofi Schulz and its affiliates shall have no obligations for such submissions or posts. They may use the ideas contained in such submissions or posts for any purposes in any medium in perpetuity, including, but not limited to, developing manufacturing and marketing products and services using such ideas.

PROMOTIONS

Kofi Schulz may include contests, promotions, sweepstakes, or other activities (“promotions”) that require you to submit material or information about yourself. Please note that all promotions may have separate rules containing specific eligibility requirements, such as restrictions as to age and geographic location. You are responsible for reading all promotion rules to determine whether or not you are eligible to participate. If you enter any promotion, you agree to abide by and comply with all promotion rules. Additional Terms & Conditions may apply to purchases of goods or services on or through the services, which Terms & Conditions are made a part of this agreement by this reference.

TYPOGRAPHICAL ERRORS

Suppose a product or service is listed at an incorrect price or with incorrect information due to a typographical error. In that case, we shall have the right to refuse or cancel any orders for the product or service listed at the incorrect price. We shall have the right to refuse or cancel any such order. Whether or not we confirmed and charged your credit card. If we cancel your purchase, we immediately issue a refund to your credit card or another payment account in the amount of the charge.

MISCELLANEOUS

Suppose, for any reason, a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable. In that case, the remainder of these Terms & Conditions will continue in full force and effect. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by an authorised representative of Kofi Schulz. Kofi Schulz will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in case of any breach or anticipatory breach by you. Kofi Schulz operates and controls the service from its offices in Austria. This service is not for distribution to persons in any jurisdiction where such distribution would be contrary to law or regulation. Accordingly, those persons who choose to access the service from other locations do so on their initiative and are solely responsible for compliance with local laws if and to the extent local laws are applicable. These Terms & Conditions (which include and incorporate the Kofi Schulz Privacy Policy) contain the entire understanding and supersede all prior understandings between you and Kofi Schulz concerning its subject matter and cannot be changed or modified by you. The section headings used in this agreement are for convenience only and will not give any legal import.

DISCLAIMER

Kofi Schulz is not responsible for any content, code, or other imprecision. Kofi Schulz does not provide warranties or guarantees. In no event shall Kofi Schulz be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or another tort, arising out of or in connection with the use of the service or the contents of the service. The Company reserves the right to make additions, deletions, or modifications to the contents of the service at any time without prior notice. Kofi Schulz services and contents are provided “as is” and “as available” without any warranty or representations, whether express or implied. Kofi Schulz is a distributor and not a publisher of the content supplied by third parties. As such, Kofi Schulz exercises no editorial control over such content and makes no warranty or representation as to the accuracy, reliability or currency of any information, content, service or merchandise provided through or accessible via the Kofi Schulz Service. Without limiting the preceding, Kofi Schulz disclaims all warranties and representations in any content transmitted on or in connection with the Kofi Schulz service or on sites that may appear as links on the Kofi Schulz service. Or to products provided as part of or in connection with the Kofi Schulz service. Including without limitation any warranties of merchantability, fitness for a particular purpose or non-infringement of third-party rights. No oral advice or written information given by Kofi Schulz or any of its affiliates, employees, officers, directors, agents, or the like will create a warranty. Price and availability information is subject to change without notice. Without limiting the preceding, Kofi Schulz does not warrant that the Kofi Schulz service will be uninterrupted, uncorrupted, timely, or error-free.
